Rob and Michele Reiner’s offspring, Jake, Romy, and possibly even the incarcerated Nick, (above) are contemplating a medical malpractice lawsuit against Nick’s doctors who switched his antipsychotic medications. (We think it’s a BAD idea) According to published reports, Nick was stable but gaining weight on his previous meds, so other antipsychotic medications were prescribed in hopes of reducing the weight gain. According to my source, Romy and Jake have already met with an attorney and they were advised that their case would be even stronger if Nick was a plaintiff, since not only are his parents dead, but he’s accused of murdering them and facing the death penalty if found guilty! Although an insanity defense is likely to happen, he could still wind up spending the rest of his life locked up in a mental institution. My source adds that while nothing has been decided just yet, don’t be too surprised if a lawsuit is filed before the statute of limitations runs out.

I don’t think this lawsuit has legs. It’s likely just an idea being kicked around. Also, Nick Reiner has had severe mental issues for a very long time; changes in his personality don’t appear to be anything new. There was a Daily Mail article the other day about the fact that Nick was a disturbed kid at 11 years old. It’s all so, so sad.

The exact legal standard for insanity varies depending on the state, but in jurisdictions that recognize the insanity defense, the defense must prove the following two elements:
Severe Mental Disease: The defendant had a severe mental illness (like schizophrenia) at the time of the crime.
Cognitive Impairment: As a direct result of that illness, the defendant did not understand the nature of their actions or did not know that what they were doing was morally and legally wrong
All the defense will do is call a couple of for hire crackpot Psychiatrists (most are more insane than their patients) to testify that Nick is stark raving mad

I hope not. Severe mental impairment didn’t get John Hinckley Jr. a get-out-of-jail card. Also, if it can be proven that Reiner can harm others, it’s not gonna happen.
